Who pays the transfer tax in Santa Clara County?

The county documentary transfer tax ($1.10 per $1,000) is customarily paid by the seller. In San Jose, Palo Alto, and Mountain View there is an additional city transfer tax ($3.30 per $1,000) that is customarily split between buyer and seller. All of it is negotiable in the purchase agreement.

What is San Jose's Measure E transfer tax?

Measure E is an additional San Jose transfer tax on sales at or above $2.3 million (as of July 2025): 0.75% from $2.3M to $5M, 1.0% over $5M to $10M, and 1.5% above $10M, applied to the full price. It does not apply below the threshold or outside San Jose.

What costs come out of a home sale besides commission?
